Terms of Service

These terms are the agreement between you and Goosto Industries (“we”, “us”) for the use of goostospeak, a club operating system for Toastmasters and similar public-speaking clubs. By creating an account or using the service you accept them. If you do not accept them, please do not use goostospeak.

1. Not affiliated with Toastmasters International

goostospeak is an independent product. It is not produced, endorsed, sponsored by, or affiliated with Toastmasters International. “Toastmasters”, “Pathways” and related names and marks belong to Toastmasters International and are used here only to describe what the software is for. Your club’s obligations to Toastmasters International — dues, reporting, education records of record, and the use of its brand — are unchanged by using goostospeak, and remain entirely between your club and that organisation.

2. Your account

  • You must be at least 16 years old, or the minimum digital-consent age where you live if it is higher, to hold an account.
  • Keep your password to yourself. You are responsible for what happens under your account until you tell us it has been compromised.
  • Give us an email address you actually control. Officers use it to reach you about your club, and it is how you recover access.
  • You can delete your account at any time from Settings. What that removes and what your club keeps is described in section 6.

3. Clubs, officers and what they can see

goostospeak is organised around clubs. When you join one, its officers can see and manage club-related information about you — your membership status, the roles and speeches you take, and your education progress — because that is what running a club requires. Officers can also correct that information and, if necessary, remove you from the club.

Officer powers are limited to their own club. Holding an officer seat in one club gives you no rights over any other club’s data.

4. Your content, and your club’s

You keep ownership of what you write and upload. You grant us the licence we need to host, back up, display and transmit it so the service can work — nothing more. We do not sell your content and we do not use it to train models.

Some content is your club’s record rather than yours alone: agendas, meeting minutes, the fact that a speech was delivered at a meeting, evaluations given, and awards recorded. That material stays with the club when you leave, with your personal details removed. Recordings and livestreams are covered by the consent rules in our Privacy Policy.

5. Acceptable use

Do not use goostospeak to:

  • harass, threaten, defame or discriminate against anyone, in an evaluation or anywhere else;
  • upload malware, attempt to breach our security, or access data belonging to clubs or members you are not part of;
  • record, stream or publish a meeting participant who has not consented to it;
  • scrape or bulk-export other members’ personal data, or use the service to send unsolicited marketing;
  • break any applicable law, or infringe anyone else’s rights.

We may suspend or close an account that does these things. Where it is safe and lawful to do so, we will tell you why.

6. Ending your account

You may stop using goostospeak whenever you like, and you can delete your account from Settings. Deleting removes your login, your email address, your profile and your notification settings, and takes you out of every club you belong to. Your club’s own records of its meetings remain with the club, with your name removed. Deletion cannot be undone.

We may close an account that has breached these terms, or if we stop offering the service. If we discontinue goostospeak we will give reasonable notice and a way to export your club’s data.

7. Paid features

Some features are paid. Prices, billing period and what is included are shown before you subscribe. Payments are handled by our payment provider; we do not store your card details. Subscriptions renew until cancelled, and you can cancel at any time — access continues to the end of the period already paid for. Purchases made through the Apple App Store or Google Play are additionally governed by that store’s own terms and refund policy. Statutory rights of withdrawal under EU/UK consumer law are unaffected.

8. Livestreaming and YouTube

goostospeak uses YouTube API Services to set up and publish meeting streams. When you start a stream, or connect a YouTube account so your club’s streams go to its own channel, you are also agreeing to the YouTube Terms of Service. You can disconnect a connected account at any time; what we store about it, and how to revoke our access to your YouTube data, is described in our Privacy Policy.

9. Availability, and what we do not promise

We work to keep goostospeak available and correct, but we provide it “as is”. We do not warrant that it will be uninterrupted or error-free, and we are not responsible for third-party services it connects to — including YouTube, email delivery and your club’s previous system. Keep your own copy of anything you cannot afford to lose.

Nothing here excludes liability that cannot lawfully be excluded — including for death or personal injury caused by negligence, or for fraud. Subject to that, our total liability to you for any claim is limited to the greater of the amount you paid us in the twelve months before the claim, or EUR 50.

10. Changes to these terms

We may update these terms. If a change materially affects your rights we will give notice in the app or by email before it takes effect. Continuing to use goostospeak after that means you accept the updated terms.

11. Law and contact

These terms are governed by Polish law, and the courts of Poland have jurisdiction. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may bring proceedings there.
